Terms of Service

1. Agreement to Terms

By accessing or using Calendence ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including business owners, staff members, and clients who interact with the platform.

2. Description of Service

Calendence is a scheduling, booking, and billing platform designed for service businesses. The Service includes online booking, staff scheduling, client management, payment processing, and related features as described on our features page.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans & Billing

  • Calendence offers multiple subscription tiers as described on our pricing page.
  • Paid plans are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period.
  • Refunds are not provided for partial billing periods.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the Service to send spam, phishing, or unsolicited communications.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell or redistribute the Service without written permission.

6. Your Data

You retain ownership of all data you enter into Calendence, including business information, client records, and booking data. By using the Service, you grant us a limited license to process, store, and display your data solely to operate and improve the platform. 7. Third-Party Integrations

The Service may integrate with third-party services such as Stripe (payments), Google Calendar, and email providers. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or practices of third-party services.

When you connect Google Calendar, our use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.

8. Intellectual Property

The Calendence platform, including its design, code, documentation, and branding, is the intellectual property of Calendence and is protected by copyright and trademark laws. You may not copy, modify, or create derivative works of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Calendence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of security vulnerabilities.

11. Termination

We may suspend or terminate your account if you violate these terms or engage in conduct that we determine is harmful to the Service or other users. You may delete your account at any time by contacting support. Upon termination, your data will be handled in accordance with our Privacy Policy.

12. Changes to Terms

We may update these terms from time to time. We will notify users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Arkansas.
